These terms govern your use of waterdamagerestorationprosper.com and the call-in referral service offered through it. Please read them before relying on the site or calling.
The short version
This site explains water damage and connects your call to an independent contractor. We do not do the work. Anything you agree is between you and that contractor, and the information here is general, so check it against your own situation.
Terms
- 1. AcceptanceBy using waterdamagerestorationprosper.com (the "Site") or calling a number shown on it, you agree to these terms. The Site is operated by Water Damage Restoration Prosper ("we", "us"). If you do not agree, please do not use the Site or call those numbers.
- 2. The referral serviceThe Site is a call-in referral service. When you call, your own call is connected to an independent local contractor who speaks with you on that call. We do not perform restoration, plumbing, mold or repair work and we do not employ the contractors.
- 3. Your deal is with the contractorAny scope, schedule, payment, warranty or other arrangement is made directly between you and the contractor. We are not a party to it and are not responsible for their work. Before work starts, ask the contractor what licences and insurance apply to it, and verify them with the relevant Texas agency.
- 4. Availability not promisedA contractor may not be available for every address or time. Connection on a call does not guarantee that anyone will take on the job.
- 5. Nature of the informationPages are general information, not professional, engineering, legal, medical or insurance advice. Rules, policies and houses differ. Check anything important with a qualified person, your insurer or the agency concerned.
- 6. SafetyWater damage can involve electrical, structural, gas and health hazards. Do not put yourself at risk following anything on the Site. If there is immediate danger, leave and call 911 or your utility.
- 7. Calls and recordingCalls may be logged and may be recorded where the law permits, with any required notice given on the call. This is a call-in service: using it does not authorize us or anyone else to call, text, email or market to you afterward.
- 8. Acceptable useDo not misuse the Site, attempt to disrupt it, scrape it in bulk, place fraudulent or abusive calls, or use it for anything unlawful.
- 9. Intellectual propertyText, images and design on the Site belong to us or our licensors. You may read and share links to pages, but may not republish them without permission. Images are illustrative.
- 10. Third-party linksLinks to agencies and other sites are for reference. We do not control those sites and are not responsible for their content.
- 11. DisclaimerThe Site and service are provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We do not warrant that information is complete or current or that any contractor will meet your expectations.
- 12. Limits on liabilityTo the fullest extent the law allows, we are not liable for indirect, incidental or consequential damages, or for any loss arising from a contractor's work or from your reliance on the Site.
- 13. IndemnificationYou agree to hold us harmless from claims arising from your misuse of the Site or your breach of these terms, to the extent the law allows.
- 14. Governing lawThese terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes belong in the courts of the county where the law requires them to be heard, subject to any rights you cannot waive.
